PRIVACY POLICY OF NEC CORPORATION (THAILAND) LTD. (“NEC TH”)

This Privacy Policy sets out how your personal information provided to NEC TH through this Site will be used and protected by NEC TH.

“Personal information” means any information provided by you, which can be used to identify you, such information include but are not limited to your name, address or e-mail address.

By accessing and browsing this Site ("Site"), you as a business partner or a web user, accept and agree to be bound by NEC TH’s Privacy Policy governing the manner and use of your Personal Information by NEC TH. If you do not accept or agree with this Privacy Policy, you should leave this Site immediately and cease any further use of any materials you have obtained from this Site and not provide NEC TH with any of your Personal Information.

Disclosure and Use of Personal Information

1. NEC TH will not reveal your Personal Information to any third party unless required under law or by any government enforcement agency or as otherwise expressly provided for under this Privacy Policy.
2. NEC TH will not disclose your Personal Information to any third party unless NEC TH has your permission and such disclosures will be restricted to (i) our professional advisers, including without limitation our lawyers, accountants and auditors; (ii) our third party service providers, including without limitation those who provide payment, administrative or other services in connection to the operation of this Site and/or of our business; (iii) any agent acting on our behalf; and/or (iv) our business alliance partners.
3. NEC TH may disclose your Personal Information if NEC TH determines that disclosure is reasonably necessary to enforce the terms and conditions herein or protect NEC TH’s operations or users.

NEC TH may share your personal information with its parent company, subsidiaries or affiliates (“NEC Group of Companies”) (some of whom may be located in countries which do not have privacy or data protection laws comparable to the laws of Thailand). In such an event, NEC Group of Companies will only use your Personal Information in accordance with this Privacy Policy and the laws of Thailand.
5. NEC TH may use your Personal Information for internal purposes such as auditing, data analysis, and research to improve NEC TH’s products, services, and customer communications.
6. NEC TH may partner with reputable companies who may need to collect and maintain certain subscriber information to help NEC TH improve NEC TH’s services and products. NEC TH will obtain your consent before sharing your Personal Information with any of them.
7. NEC TH may use your Personal Information to communicate with you for marketing or research purposes. In this regard, NEC TH will also provide NEC TH’s subscribers with straightforward procedures to provide or withdraw consent to receive the latest marketing offers or promotions, or for NEC TH to provide information to any third party.
8. NEC TH will collect your Personal Information when you sign up for product information, participate in direct marketing etc.
9. NEC TH will not hold your Personal Information for longer than NEC TH believes is reasonably necessary for the purposes set forth in this Privacy Policy or such longer period as required by law
10. If NEC TH sells all or part of its business, NEC TH may include your Personal Information as part of NEC TH’s assets. This will enable the acquirer to continue to provide services to you.
11. This Privacy Policy shall apply to all of the services offered by NEC TH and its affiliates but excludes services that have separate privacy policies that do not incorporate this Privacy Policy.
12. By providing NEC TH with your Personal Information, you consent to any and all such disclosure and use.

Cookies

NEC TH may use cookies to recognize and track your computers. Cookies are small pieces of data stored on your computer’s hard drive, rather than on the websites. NEC TH’s use of cookies is to (i) help subscribers speed up their activities on this Site; (ii) track frequency and use of this Site and NEC TH’s services; (iii) measure aggregate usage and traffic to this Site and specific services and offerings; and (iv) eliminate the need for you to enter your password frequently during a session. You may configure your browser to reject cookies but this may interfere with some functionality of this Site and the services.

We take protecting your Personal Information very seriously and assure you that your Personal Information will be treated with high standards of security to ensure that your Personal Information is safeguarded against any loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. However, there are always risks involved with providing Personal Information as no technology is completely risk-free or can be guaranteed to be 100% secure. In this regard, NEC TH will take the appropriate security measures to prevent and minimize such risks but NEC TH will not be held responsible in the event that any third party gains unauthorized access to your Personal Information.

Modification of this Privacy Policy

NEC TH reserves the right to modify and change the contents of this Privacy Policy from time to time. You are responsible for regularly reviewing the contents of this Privacy Policy and agree that continued use of this Site and NEC TH’s services after any such changes or modification shall constitute your consent to such changes or modification. NEC TH does not and will not assume any obligation to notify you of any changes or modification to the Privacy Policy.

Links to third party websites on this Site are provided solely as a convenience to you. This Privacy Policy you just read is applicable only when you are on this Site, once you are linked to another website, you should read that website's privacy policy/statement before disclosing any personal information. You agree that NEC TH shall not be responsible for and hereby disclaim to the maximum extent permissible at law, any liability for the security or privacy practices included on or operated by these third party websites.
 
Contractual Obligations

This Privacy Policy is not intended to, nor does it create any obligations on NEC TH in respect of any other party or on behalf of any other party.

Severity

If any of part of this Privacy Policy is invalid or unenforceable, it will be struck out and the remaining parts will remain in force.

Governing Law

This Privacy Policy will be governed and construed in accordance with the laws of Thailand. Use of this Site is unauthorized in any jurisdiction that does not give full effect to all provisions of this Privacy Policy, including without limitation to this paragraph and liability exclusions above.
